Terms of Service for Access to CrescentCitySoles.com By accessing CrescentCitySoles.com, you become a Subscriber and agree to be bound by all the terms and conditions set forth in this agreement. The parties to this Agreement are you, the Subscriber, and CrescentCitySoles.com (“CrescentCitySoles.com”may be substituted with “owner of website”). This Agreement is subject to change by CrescentCitySoles.com at any time, and changes are effective upon notice to the Subscriber. I, the Subscriber, agree to be personally liable and fully indemnify CrescentCitySoles.com, its creator, owner, affiliates, and agents, for any and all damages directly, indirectly and/or consequentially resulting from my attempted or actual unauthorized downloading or other duplication of materials from CrescentCitySoles.com, alone or with, or under the authority of, any other person(s), including, without limitation, any governmental agency(ies), wherein such damages include, without limitation, all direct and consequential damages directly or indirectly resulting from unauthorized downloading of materials from CrescentCitySoles.com including, but not limited to, damages resulting from loss of revenue, loss of property, fines, attorney’s fees and costs, including, without limitation, damages resulting from prosecution and/or governmentally imposed seizure(s), forfeiture(s), and/or injunction(s). Subscriptions may not be assigned or transferred to any other person or entity. Subscriber must promptly inform CrescentCitySoles.com of the following: changes in the expiration date of any credit card used in connection with the Service; changes in home or billing address; and apparent breaches of security, such as loss, theft, or unauthorized disclosure or use of an ID. Until CrescentCitySoles.com is notified of a breach in security, the Subscriber will remain liable for any unauthorized use of the Service. Subscribers are responsible for providing all personal computer and communications equipment necessary to gain access to the Service. Access to and use of the Service is through the use of a subscription ID. Each Subscriber must keep his subscription ID strictly confidential. For security and confidentiality reasons, CrescentCitySoles.com will not release subscription ID's. Unauthorized access to CrescentCitySoles.com is theft constituting breach of this Agreement and violation of law. Subscription to CrescentCitySoles.com may be terminated at any time, and without cause, by either CrescentCitySoles.com or Subscriber. You agree to be personally liable for all charges incurred by you during or through the use of CrescentCitySoles.com. Your liability for such charges shall continue after termination of your subscription for any reason. No charges will be prorated for cancelling your subscription prior to the term of its full length. Any liability of CrescentCitySoles.com, including without limitation any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortuous behavior, negligence, or under any other cause or action, shall be strictly limited to the amount of subscription fee paid by or on behalf of the subscriber to CrescentCitySoles.com for access to a paticular gallery or galleries. Some jurisidictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you. You must legally be an adult where you reside to become a member and gain access to CrescentCitySoles.com. Your subscription fees are non-refundable. THERE ARE ABSOLUTELY NO REFUNDS FOR ANY REASON. All images, videos, text and content in this site are copyright protected under US and international laws. and may not be redistributed or used in any way without the expressed written permission of CrescentCitySoles.com. Anyone caught copying and redistributing the contents on this site will be prosecuted to the fullest extent of the law. Subscribers of this site are allowed to download images, text and movies to their personal computers for personal use only and does not entitle or authorize the Subscriber to be or become a Secondary Producer. Subscribers or any other persons or parties are not allowed to distribute any of the contents of CrescentCitySoles.com. That includes, newsgroups, TGP’s, other sites, content CD’s and everything else. Posting or distributing subscription ID's and/or any part of these images to newsgroups, other sites or individuals is a violation of CrescentCitySoles.com Terms of Service and will result in the revocation of your subscription and possible civil and criminal prosecution. Connections to the internet and world wide web can be interrupted, disrupted or unavailable at anytime for any reason. In joining the Subscriber agrees not to hold CrescentCitySoles.com liable for any inabilities to connect, download failures, blackouts, disruptions or delays in service from the Subscribers providers or CrescentCitySoles.com service providers. Any inability to retrieve content at anytime for any reason from CrescentCitySoles.com shall not be cause for refund, restitution, or remittance. This Agreement contains the entire agreement between the Subscriber and CrescentCitySoles.com regarding Subscribers’ use of CrescentCitySoles.com and all materials directly and indirectly related thereto. This Agreement supersedes all prior written and oral understandings, writings, and representations and may only be amended upon notice by CrescentCitySoles.com . This Agreement shall be governed by and construed under the laws of the State of Maryland and the United States, except as governed by Federal law. The application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable while all other provisions shall survive.
